<p>The first and perhaps most important reason many negotiators fail is that the vast majority of negotiators never translate their general knowledge of negotiation into specific skill(s) that can be called upon with the same ease as the multiplication tables, for example.</p>
<p>Ask most people who negotiate professionally what framework of negotiation they use, and they will look at you as though you are from another planet.</p>
<p>Even when one attempts to clarify the question by naming obvious possibilities (such as the Karrass framework, the Harvard framework, the Cohen framework, and the Fisher/Ury framework), many negotiators are at a loss to come up with a specific answer. And many who do give a specific answer are rarely able to follow up with even the most basic facts surrounding the framework they say they use every day of the week.</p>
<p>In my book, Beyond Negotiating: From Fear to Fearless, I describe how we traveled throughout the United States, Canada, Mexico, and elsewhere asking participants from our workshops whether or not they were familiar with Steven Covey&#8217;s The Seven Habits of Highly Effective People. The vast majority of the participants quickly raised their hands, indicating they had read or were aware of this great resource. I then asked, &#8220;How many people know what habit number one is?&#8221; Virtually everyone lowered their hands, indicating they could not recall the first of Dr. Covey&#8217;s seven habits. Ironically, the first habit is &#8220;Be Proactive.&#8221;</p>
<p>The results are identical when we ask professionals who have attended any number of negotiating workshops questions such as, &#8220;What&#8217;s the first rule or guideline you were given in the negotiating course you attended recently?&#8221; Inevitably, respondents are at a loss to recall any more than mere fragments of what was presented during the courses they&#8217;ve attended or from the books they&#8217;ve read on the subject of negotiation.</p>
<p>By contrast, if you ask a person who negotiates professionally what the sum of two plus two is, what would their answer be? Any answer other than four would likely be considered incorrect, as few would argue that the product of two plus two is indeed four.</p>
<p>Nonetheless, ask that same person what negotiating framework he/she uses, and you will likely get a blank stare. For those who think they have an answer to the previous question, follow up by asking, &#8220;What is the primary tenet of the framework you use?&#8221; The vast majority of respondents will fall short of a coherent answer.</p>
<p>Why is it that so many who agree that the memorization of the multiplication tables is an important step prior to the study of Algebra, see no relevance in committing the basic tenets of a specific negotiating framework to memory as a fundamental part of establishing themselves as expert negotiators?</p>
<p>The point isn&#8217;t that everyone should select or necessarily follow any particular negotiating framework; the point is that without first committing some specific negotiating framework to memory, the development of truly exceptional negotiating skills is practically impossible to achieve, outside of a narrow professional specialization or set of issues.</p>
<p>Further, the lack of a specific negotiating framework also makes it far more difficult to teach others how to duplicate a result &#8211; as in cases where companies negotiate the same or similar issues continuously &#8211; which means that the lack of a specific negotiating framework becomes more and more costly the longer a relationship lasts, since mistakes are repeated time and time again.</p>
<p>And what happens when the result of a negotiation isn&#8217;t one that you want to duplicate? How can a negotiator ever hope to understand where a particular negotiation went off track &#8211; if that negotiator was never certain which track the train was on in the first place? Simply put, the vast majority of professional negotiators don&#8217;t have a clue where their unsatisfactory negotiations went wrong or how to avoid similar mistakes in the future. And it&#8217;s precisely because they lack a specific negotiating foundation from which to analyze their strategy or tactics.</p>
<p>If you want to become a wine expert, you probably won&#8217;t achieve your goal by going out and drinking one bottle of twelve different wines over a long weekend. The better approach would be to drink twelve cases of one wine over time and then compare and contrast the characteristics of that wine to the characteristics of any other wine in the world. The resulting insight and knowledge is in fact your expertise &#8211; and your ability to make such comparisons consistently under a variety of circumstances is your skill. Yes, there are extraordinary negotiators who have never attended a negotiating course or read a book on the subject, but they are very, very few and far between. If you know a natural-born expert negotiator ask him/her if they would be willing to teach you how to do what they can do. More often than not, there is a vast difference between someone who knows how to do something and someone who also knows how to teach someone else how to achieve the same result.</p>
<p>Building your negotiating expertise by committing to and then sticking with a specific framework of negotiation until you&#8217;ve learned the fundamentals of that framework will separate you from the vast majority of professional negotiators. It will also significantly increase the level of success you are capable of achieving in your negotiations and insure that you will avoid the first fundamental reason many negotiators fail.</p>
<p>The second fundamental reason negotiators fail is that most negotiators focus on what they believe their starting positions are rather than focusing on the desired outcome. In other words, far too many negotiators focus on the weaknesses or strengths of their initial positions rather than focusing on the accurate assessment and quantification of the real challenges and issues standing between themselves and their counterparts.</p>
<p>One of the most important skills a negotiator can develop is the skill of knowing how to assess and quantify the real issues that stand between the parties &#8211; rather than acting or reacting based upon a perception of what one believes those issues to be. This is one of the most important concepts taught by authorities such as Dr. Chester L. Karrass, author of Give and Take, and yet even many seasoned negotiators make the mistake of over estimating or underestimating their strengths and weaknesses &#8211; and the positions, strengths, and weaknesses of their counterparts.</p>
<p>Learning to accurately assess and quantify the obvious and hidden issues between the parties involved in a negotiation is a skill that requires disciplined focus and a systematic approach as precise as reading Braille or deciphering Morse code. To do it consistently and with great accuracy requires more than a measure of good luck and a handshake, because, as Karrass says, &#8220;In business as in life you don&#8217;t get what you deserve; you get what you negotiate.&#8221;</p>
<p>The third fundamental reason negotiators fail is fear. No matter how much you know about negotiation or about the strengths and weaknesses of your counterpart, if you lack the courage, discipline, and determination to act in the face of risk or uncertainty, you will almost always fall short of achieving the best possible outcome in a given situation. Fear will always invite you to aim for less than you are capable of achieving. Fear vehemently discourages negotiators from pursuing what M. Scott Peck calls &#8220;The Road Less Traveled,&#8221; which is precisely the road that must be traveled in order to craft agreements that truly reflect and protect the interests of all parties involved (if that is your objective). If you are engaged in a competitive struggle where your primary objective is merely to prevail, then fear must be conquered first &#8211; or you risk being defeated by it long before you are defeated by your counterpart at the negotiating table.</p>
<p>Defeating fear demands a genuine commitment, a methodical process, and a journey beyond the boundaries of flawlessly executed tactics and techniques.</p>
<p>Anyone can become a significantly better negotiator quickly and systematically by eliminating these three fundamental reasons negotiators fail. First, identify and commit to one of the internationally recognized frameworks of negotiation and thoroughly review and memorize the primary tenants of that framework until they are second nature to you. In other words, go an inch wide and a mile deep in one framework of negotiation rather than go a mile wide and an inch deep in many different frameworks of negotiation. Slowly, you will expand your skill, knowledge, and expertise. Second, cultivate an ability to identify, assess, and quantify the obvious and hidden issues that separate the parties at the beginning of a negotiation, then focus on achieving your desired outcome rather than your perceptions of the positions, strengths, and weaknesses of the other parties. Finally, eliminate fear by moving Beyond Negotiating: From Fear to Fearless, and you will immediately achieve greater success and greater consistency in your negotiations than you ever thought possible.</p>

<p>Negotiation is offered by settlement companies which communicate with creditors and debt collectors in order to reduce your outstanding balance. Creditors agree to negotiate depending upon the status of your delinquent accounts, your total debt amount and the age of the debt accounts. Here are the <strong>6 steps</strong> in a debt negotiation program.</p>
<p><strong>Debt counseling</strong>: A debt negotiation or settlement company will offer you a free counseling session. Herein a counselor will review your situation to find out if a debt negotiation program is suitable for you.<br />
<strong>Realistic budget</strong>: The company will help prepare a realistic budget for you in order to free up cash flow so that you can pay off your bills after negotiation. The budget gives a clear idea of what you can pay and how much the company needs to negotiate on your behalf.<br />
<strong>Calculate program term</strong>: The company will review your income and set the program term for 2-4 years depending upon how much funds you can accumulate for debt payoff.<br />
<strong>Trust account</strong>: The company will create a trust account (bank account) for you. Instead of paying creditors, you&#8217;ll have to deposit a monthly payment into the trust account. This continues till the funds accumulated are enough to start the negotiation.<br /> The trust account does not earn interest. But it is insured by the FDIC (Federal Deposit Insurance Corporation) for an amount up to 0,000. You will receive monthly statements of all transactions on your trust account and the funds available for negotiation.<br />
<strong>Negotiation with creditors/CAs</strong>: Negotiation starts off when you&#8217;ve saved about 50% of your outstanding balance into the trust account. The amount negotiated depends upon the creditor/CA and the money you owe.<br />
<strong>Settlement offer</strong>: The negotiation company will not settle the debt without your approval. Once the creditors (or CA) accept a reduced settlement offer, the company will request them to send you the offer in writing. Based on the offer, you&#8217;ll make a lump sum payment to your creditors from the funds in your trust account. Your debt is thus settled at an amount lower than what you owe.<br />
How do you benefit from negotiation?<br />
Debt negotiation offers you the following benefits.<br />
<strong>Reduced balance</strong>: Negotiation helps to reduce your outstanding balance so that you can pay off bills faster than you&#8217;ve ever thought possible.<br />
<strong>Lower payment</strong>: Your monthly payment to the negotiation company is comparatively lower than what you&#8217;ve been paying your creditors.<br />
<strong>No extra charges</strong>: Negotiation helps you to avoid paying extra charges like late payment dues or over-the-limit charges (for credit cards).<br />
<strong>Avoid harassment</strong>: Your creditors and collection agencies may stop making harassing calls for debt repayment.<br />
<strong>Negotiate account status</strong>: The negotiation company may negotiate with your creditors/CAs and try to get the account reported in your favor. How much do you pay for negotiation?</p>
<p>Debt negotiation fees depend upon the number of credit accounts you have, the amount you owe and the money you can save through negotiation. Some companies may charge 25%-35% of what you save.</p>
<p>Does debt negotiation hurt your credit?</p>
<p>Creditors don&#8217;t agree to negotiate the debt until and unless you&#8217;re behind for 3 months or more. Moreover, negotiation requires you to stop paying creditors till you have gathered enough funds to settle your bills. Since you don&#8217;t make payments for a number of months, your credit report shows the account as &#8220;delinquent&#8221;. Your account may also be charged-off by the creditor or collection agency. Such things ruin your credit and bring down your score. However, once you settle the bills, your credit score will improve gradually with time.</p>
<p>What are the tax consequences?</p>
<p>When your bills are settled, the IRS considers the amount forgiven as taxable income. For example, if your forgiven debt is 00 and you&#8217;re in the 15% tax bracket, then you&#8217;ll have to pay 5 as income tax. However, you will not be liable for such taxes if the creditor settles your debt because you protest an owed amount.</p>
<p>With debt negotiation, your credit gets tarnished and you may incur taxes on forgiven debt. However, negotiation reduces your liability towards debt and here lies its importance. The purpose of debt negotiation is to help you fulfill your obligation so that you can lead a debt free life.</p>

<p>Getting selected in a job interview is only half the job done; the other half is salary negotiation. When negotiating a salary, timing is important. Asking the salary amount right in the first instance would be imprudent. It is important to get the job offer or reach the final interview first before negotiating the salary. This article gives some tips on salary negotiation, helping you in negotiating your salary with a prospective employer.</p>
<p>There are many different situations that one would face regarding the salary that he or she is offered depending on the type of job and the type of organization. In some jobs there may not be any room for negotiations, you simply have to accept or reject what is offered. If you don&#8217;t like what is offered, you have to look for another job.</p>
<p>Looking from an employer&#8217;s perspective, if you have fixed X amount as the salary for a particular job and if somebody is willing to work for X-Y amount, you would have saved Y amount for the company. Hence you may initially offer X-Y amount to see if the prospective employee accepts it and give yourself room for negotiation if required. Remembering this strategy, when the employer asks your last pay drawn, you must disclose the true amount and also explain why you are worth more like you were responsible for increase in sales by Z% or you have saved Z amount for the company and so on.</p>
<p>If in an interview you are offered X amount as salary and asked for your opinion, there are some options for you:</p>
<p>1) You can remain silent in which case the employer may think that you feel it is too low and might raise the offer</p>
<p>2) Explain to them the last salary that you were drawing and that you expect a raise by Y amount and the reasons for the same. The Y amount should be a few thousand dollars more than what you are willing to settle; this would give you room to negotiate in case the employer wants to bring it down</p>
<p>3) Accept the offer on the condition you expect the salary to be revised after a few months on the basis of your performance. This offer is most likely to be accepted by the employer but you are taking a risk in that you should demonstrate tangible benefits to the employer within the agreed time.</p>
<p>Depending on the position you may also ask for a share of the profit or benefit that has accrued to the company because of your efforts. Like if you are in sales department, a share of the X% increase in sales that you have brought to the company or if it is production department, a share of the X amount of saving because of your efforts etc.</p>
<p>Whatever be the case, it is important to negotiate your salary at the time of interview or later in order to get what you are worth.&#13;

<p>Debt negotiation is a common process. During this process, people hired by a debtor try and negotiate the loan amount with credit companies. Generally after this negotiation, the loan amount negotiated is not just lower, the debtor is also freed from all the loans after consolidation of all loans after this one. </p>
<p>Debt negotiation helps all those who have been experiencing financial difficulties. It is not for all those experiencing difficulties, it is also for those who are found to be totally unable to pay off such loans. This study is made by the counselors hired by the person. The credit company may or may not agree to this negotiation, if it feels that the person can very well pay off the loan.</p>
<p>The benefit of negotiation happens that the person who is in debt can pay off at least minimum of loan amount. This saves the credit company from hiring legal teams, filing foreclosure and also trying to get money by selling person&#8217;s assets. However, in case where the fixed asset is not mortgaged, it is common that the company may end up losing up all the money that is owned by the creditor.</p>
<p>Debt negotiation is one of the common processes during debt settlement and debt arbitration. This negotiation needs to be done, in case the debt is to be repaid at least in part to the company. Negotiation will always help a debtor against bankruptcies. </p>
<p>During debt negotiation there are a variety of things taken under consideration. These are the earning capacity, number of persons earning, total income of the family as against total debt and liabilities. This also ascertains whether or not the family or individual will be able to repay the loan. If it is found that the loan cannot be repaid rather only the amount if negotiated can be repaid, in such cases companies allow debt negotiation. If it is found that the family or individual can repay loan the credit company will try to get complete amount from the person.</p>
<p>Most of the times, debt negotiation is done by a credit counselor. This could be a person working privately for a company or could be an independent entity. In both cases, it is the main aim of this person to get your debt reduced considerably. You may have to pay this person, however it does not need to be immediate. At times the payment is determined depending upon how much debt has been actually reduced. Commission payment is always the calculated as percentage of amount reduced in debt. Payment terms are determined by both parties mutually.</p>
<p>Upon reduction in debt, terms of payment, rate of interest and duration of the loan is also determined. Generally after debt negotiation, fresh papers are prepared. It depends on the credit company to determine whether or not credit rating of this person would be affected. </p>
<p>Debt negotiation is often the most fruitful way of getting money back from the debtor, it saves time and also it saves the debtor his dignity. It can also help the debtor in stabilizing his financial status. </p>

<p>Is it wrong to negotiate with your children? Not according to a feature article:  &#8220;Negotiate Better Relationships with Your Children&#8221; in the February issue of Negotiation.  Negotiation is a monthly newsletter that offers valuable negotiating tools and techniques developed by leading experts at the Program on Negotiation (PON) at Harvard Law School, a world-renowned university consortium including Harvard Law School, Harvard Business School, Tufts University and Massachusetts Institute of Technology.</p>
